Kakao Brain Corp. (“Kakao Brain,” “we”,” “us,” or “our”) owns and provides this KARA-CXR (AI-generated radiology report based on DICOM image or similar radiologic image) which collects some Personal Data from its registered users (“Users,” “you,” or “your”). We understand that privacy is of great importance to all Users. Thus, we are committed to protecting your privacy of information through our compliance with the following privacy policy (“Privacy Policy”). This Privacy Policy is subject to change pursuant to relevant laws, regulations, and Kakao Brain’s internal operation policies, in which case any modifications or updates to this Privacy Policy will be disclosed accordingly.

Types of Data Collected

Among the types of data that this KARA-CXR collects from you, by itself or through third parties, are: first and last name, email address, phone number, country and state, title, organization/company name, any additional supporting documentation or URLs you provide; Cookies; Usage Data (the “Personal Data”). Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this KARA-CXR.

Cookies consist of small sets of data stored in the User's browser, which are unique identifiers, web beacons, embedded scripts, e-tags, etc. that enable the tracking of Users, for example by accessing or storing information on the User’s device.
Usage Data consist of information collected automatically through this KARA-CXR (or third-party services employed in this KARA-CXR), which can include: the IP addresses or domain names of the computers utilized by the Users who use this KARA-CXR, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server's answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the User, the various time details per visit and the details about the device operating system and/or the User's IT environment.

Purpose of Processing Personal Data

Kakao Brain collects and processes your Personal Data so that we can provide the KARA-CXR to you, comply with our legal obligations, protect our rights and interests (or the Users or third parties), detect any malicious or fraudulent activity, as well as the following: contacting the user, analytics, web services, and hosting, user database management. Your Personal Data processed by Kakao Brain is not used for any purpose other than this KARA-CXR, and we will take necessary measures when any change occurs in the purposes of use. Unless specified otherwise, all Personal Data requested is mandatory and failure to provide your Personal Data may make it impossible for you to register for and use the KARA-CXR. Any use of Cookies or of other tracking tools by Kakao Brain or by the owners of third-party services used by this KARA-CXR serves the purpose of providing the KARA-CXR to the User.

Method of Processing Personal Data

Kakao Brain takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of Personal Data. Our processing is carried out using computers and/or IT-enabled tools, following organizational procedures and modes strictly related to the purposes indicated. Your Personal Data may be accessible to certain types of persons involved with the operation of this KARA-CXR (administration, product developer or engineer, business development). Your Personal Data is processed at Kakao Brain's operating offices and in any other places where the web or cloud server involved in the processing are located. Depending on the User's location, data transfers may involve transferring your Personal Data to a country other than your own.

Personal Data Retaining Period

Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the Users’ consent. Unless otherwise required by the law, Kakao Brain will retain your Personal Data so long as you have an active registered account for the KARA-CXR. If you delete your account, your Personal Data will be permanently deleted within one month.

Provision of Personal Information to Third Parties

Kakao Brain does not provide your Personal Data to any third party without your consent. However, we may disclose your Personal Data to a third party when required by the law.

Accessing Your Personal Data

We have created mechanisms to provide you with the following control over your Personal Data: you can access, review, correct and/or change your Personal Data by logging into your account and visiting your account profile page. You may also send us an email at kara-contact@kakaobrain.com to request access to, correct or delete any Personal Data that you have provided to us. In some cases, we may not be able to delete your Personal Data except by also deleting your user account.

Legal action

The User's Personal Data may be used for legal purposes by Kakao Brain in a court or in the stages leading to possible legal action arising from improper use of this KARA-CXR.

The User acknowledges and understands that Kakao Brain may be required to disclose your Personal Data upon request of government authorities or agencies.

Changes to this privacy policy

Kakao Brain reserves the right to make changes to this Privacy Policy at any time by notifying its Users on this page and possibly within this KARA-CXR and/or sending a notice to Users via any contact information available to Kakao Brain as far as technically and legally feasible. It is strongly recommended that you check this page often, referring to the date of the last modification listed at the bottom.

Should the changes affect processing activities performed on the basis of the User’s consent, Kakao Brain will collect new consent from the User if required.

This section applies to all Users in the European Union, according to the General Data Protection Regulation (the “GDPR”), and, for such Users, supersedes any other possibly divergent or conflicting information contained in the privacy policy.

Legal Basis for Processing of Personal Data

Kakao Brain may process Personal Data relating to Users if one of the following applies:

Provision of Personal Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof.
Processing is necessary for compliance with a legal obligation to which Kakao Brain is subject.

Processing is necessary for the purposes of the legitimate interests pursued by Kakao Brain or by a third party.

Further Information About Retention Period

Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the Users’ consent. Therefore, Personal Data collected for the purposes of Kakao Brain’s legitimate interests shall be retained as long as needed to fulfill such purposes. The rights of Users Based on the General Data Protection Regulation (GDPR)

You may exercise certain rights regarding your Personal Data processed by Kakao Brain.

Access your Personal Data.
Verify and seek rectification.

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in Kakao Brain or for the purposes of the legitimate interests pursued by Kakao Brain, you may object to such processing by providing a ground related to your particular situation to justify the objection.

Users must know that, however, should your Personal Data be processed for direct marketing purposes, you can object to that processing at any time, free of charge and without providing any justification. Where the User objects to processing for direct marketing purposes, the Personal Data will no longer be processed for such purposes.

How to Exercise Your Rights

Any requests to exercise your rights can be directed to Kakao Brain through the contact details provided herein. Such requests are free of charge and will be answered by Kakao Brain, as early as possible and no later than one month, to provide the User with the information required by law. Any rectification or erasure of Personal Data or restriction of processing will be communicated by Kakao Brain to each recipient, if any, to whom the Personal Data has been disclosed unless this proves impossible or involves disproportionate effort.
